Terms of Service
Last updated 8 October 2026 · ZaFlip is operated by AquaSoft, Stellenbosch, South Africa
Plain language: ZaFlip is a marketplace that connects buyers and sellers of South African domains. We verify ownership, hold payment through PayFast, and the domain transfers directly between registrar accounts. These terms spell out the rules so there's no ambiguity when a transaction goes well or badly.
1. Who these terms are between
These terms are an agreement between you (whether you're browsing, buying, or selling) and AquaSoft (Werner Swanepoel, Stellenbosch, South Africa), the operator of ZaFlip (zaflip.co.za). By creating an account, listing a domain, or paying for one, you accept these terms.
2. What ZaFlip is and isn't
- ZaFlip is a marketplace. We introduce buyers and sellers and handle the payment flow. We don't own the domains being sold.
- ZaFlip is not a registrar. Domains are registered at and transferred between third-party registrars (domains.co.za, Afrihost, Xneelo, etc.). We never custody a domain.
- ZaFlip is not a legal or tax advisor. You're responsible for the tax implications of your own purchases and sales.
3. Accounts
You need an account to list a domain, make an offer, or buy. One account per person. You're responsible for keeping your login secure and for anything done through your account. You can delete your account at any time (see the Privacy Policy), though we retain transaction records for the period required by South African tax law.
4. Listing a domain (sellers)
- You must own the domain you're listing. We verify this via a DNS TXT token on your domain before the listing goes live. False listings will be removed and the account suspended.
- You must have the right to transfer it. Domains locked by your registrar, in dispute, or subject to a trademark complaint should not be listed.
- Pricing is yours. Set an asking price, or accept offers only. You can withdraw a listing at any time if it hasn't been sold yet.
- No trademark infringement. Don't list domains that are clearly someone else's registered trademark. If a legitimate rights-holder complains, we may remove the listing and refund any pending buyer.
- Transfer within 7 days of payment. Once ZaFlip receives payment, you must initiate the registrar transfer to the buyer within 7 days. Repeated failure to transfer may forfeit the sale.
5. Buying a domain
- Pay via PayFast. ZaFlip accepts the buyer's payment through PayFast and holds it until the seller confirms transfer.
- Transfer completion. You're responsible for having a registrar account ready to receive the domain. If the seller pushes the domain and you have no account to accept it within 14 days, the sale may be cancelled and refunded minus payment-processing fees.
- "As-is" basis. Domain names are sold as-is. We verify current ownership and basic registrability status; we don't guarantee traffic, SEO value, revenue history, or future renewability (which depends on the registry).
- Offers are not binding until accepted. You can withdraw an offer any time before the seller accepts it.
6. Fees
- Listing is free. No upfront charge, no featured-listing fees, no payment-method surcharges.
- Commission on sale: 10% of the final sale price, deducted from the seller's payout.
- Buyer pays no commission to ZaFlip. The price you see is what you pay (plus PayFast's own processing fees where applicable).
- Payout to seller: paid out manually to the seller's nominated PayPal address once the transfer is confirmed, typically within 2 business days.
7. Refunds and disputes
- Seller fails to transfer: buyer is refunded in full, minus any non-refundable PayFast processing fees.
- Transfer completed but domain is defective (e.g. in redemption, under UDRP action, undisclosed trademark dispute): raise the issue within 7 days of transfer by emailing info@zaflip.co.za. We'll mediate.
- Change of mind after transfer: no refund. The sale is final once the domain is in the buyer's registrar account.
- Disputes we can't resolve go to arbitration under South African law.
8. Prohibited uses
Don't use ZaFlip to:
- List domains you don't own or don't have authority to sell.
- Make false claims about traffic, revenue, or history of a listed domain.
- Infringe anyone's trademark or intellectual property.
- Launder money, finance illegal activity, or process payments for prohibited goods.
- Scrape the site, reverse-engineer the API, or submit automated listings in bulk without permission.
- Attempt to circumvent the ZaFlip payment flow (e.g. "pay me directly outside the site to avoid commission").
Breach of this section can result in listing removal, account suspension, forfeiture of pending payouts, and (where applicable) referral to the relevant authorities.
9. Our liability
ZaFlip provides the marketplace "as-is". We do our best to keep the service running, verify sellers, and handle payments securely, but we don't guarantee uptime, that any particular listing will sell, or that any particular domain is a good investment. Our maximum liability for any claim is capped at the fees we received from the relevant transaction, or R1 000, whichever is higher.
10. Changes to these terms
We may update these terms as the marketplace evolves. Material changes will be announced on the home page and (if you're a registered user) emailed to you. Continued use after an update means you accept the new terms. The "Last updated" date at the top of this page reflects the most recent change.
11. Governing law
These terms are governed by the laws of the Republic of South Africa. Any dispute arising from these terms or your use of ZaFlip is subject to the exclusive jurisdiction of the South African courts.
